No, I'm not talking about someone stealing the images that you have edited to make your blogskin. What I am talking about here is how the images that you have edited to make your blogskins were probably actually stolen from another site and not properly credited in return.
Popular sites that are often raided, violated, and uncredited include, but are not limited to:
Deviantart: Yes, it is often listed as a resource on many sites, but it is a resource for its resource (brushes, textures, etc), stock images, and downloadables sections. Those are the only areas of deviantart where people can actually use the art that is featured. If you take art from personal artists who submit in photography, photomanipulation, anime, drawing, traditional art, digital art, or any other section, it is considered copyright infringement and it is theft. In other words, you are just as bad, if not worse, than those people who take your layout and do not give you credit.
Except the individuals on deviantart actually put more time into their art that you did on your layout. Oh and it's illegal to take that art. Oh, and you're not even allowed to use it even if you were to give credit. The bottom line is this: if you don't have written permission from the artist, you are not allowed to use it.
gettyimages.com: You're not supposed to use the images at gettyimages.com, because those are actually images that people submit for sale. In other words, it's just like deviantart. All of the vectors on that site where created and submitted by the artists and were meant to be sold. You can't use them if you didn't buy them.
In other words, you're not only stealing the copyrights but you're stealing the artist's profits. Good going.
Brushes: I'm sure that most people don't realize that you actually need to credit brushes, but you do. You need to credit all resources that you use on your layout, because that is part of the agreement when you download the brushes. You using brushes without crediting is like someone using your layout and taking off the credit link.
It's wrong.
Remedies:
1) scanning your own images from magazines.
2) drawing your own images
3) making your own brushes
4) e-mailing the artist and obtaining legitimate permission
5) buying the rights to the images.
6) using legitimately free image services (stockxchange, etc).

All very good info for everyone to read and understand. I receive regular reports from people who are upset that someone has stolen artwork for them to use in their skins. When that can be verified, I disable the skins. On very rare occasions, I have banned people from the site. I can't police every skin here, but through the complaint mechanism I do catch a lot. And it doesn't make me happy when I have to do that. Please follow fatalistic_pessimism's advice above.
Except, I don't think that remedy #1 is legal either.

I agree. But then , you can't say that for everyone. I mean, some people have been making graphics / layouts for a long time. They might have forgotten the source. I did. I have loads of nice pics that I find cute, but just can't think of a design that suits it. I guess in this case, people who view the skins should tell the person who made the skin the URL of the source if they happen to know it. And there are also those who take down the credits on the skins even though the skinner did put it on. Now THAT is really bad!

about the solution... scanning your pics from magazines? i've looked a diff. magazines and they all have copyright on their images too. so please tell me what mags you are talking about because it doesn't seem right to me. copyright is copyright. right? whether it's on the internet or on magazines.

interresting... ok. look at the top af the page. ( where the post begins ) it talks about image theft (unless i misread)

i don't get it. what does it mean?
i've looked for pictures in magazines to scan but the are all protected by copyright also.
is there some magazine where i can just take pics and scan? or is this remedy false?

Actually, i think these places that we "steal" from get LOTS of free publicity and much more traffic from the fact that we are "stealing" them!
but anyway, fatalistic_pessimism has a VERY VERY valid point.

Just checking, how about an image like say, from ROXY's website? Is permission needed? Or acknoledgements?

Definitely yes. All photos from Roxy and all other brands are taken by professionals, and they pay their models and photographers. Its all copyrighted, and don't bother asking. 99% chance they won't give you permission.
Lol that's why I have photoshop and illustrator to create what I need.

If we happen to see an image from maybe any of those places, and we get inspired from it and make something from scratch but looks similar with alterations, is that theft?

I don't think that's necessarily theft, but it may depend on how similar to the original you are.

I read in another thread however, where a "blogskinner" wrote in to Getty Images, who said that it was fine to take their images to use for layouts, but not for commercialism. If I remember correctly.

Wow.. big huh? Well I guess, if we used their image so it's probably good though.. but we have to write it in the bottom of our skins that is taken from.. (blablabla). I think it's better than we have to look around which one is copyright. But I think almost all art is copyrighted by themselves. Isn't it?
If I make one pic, I will proud if someone taken from me and put my name in their. So that means I'm a popular, isn't it? Well, just guess.. hehehe

I think in deviant art, you still have to ask permission from some stock artists so you could use their photos legally here..

thanks for that. I've been going around the internet looking for info on image theft. I was going to submit a skin, but was worried I wasn't really free with all the copyright stuff yet.

question: is it image theft to use all those fashion photos in lj communities like foto_decadent and ru_glamour in blogskins? I couldn't find any copyright stuff about this anywhere, and lots of blogskins being submitted get photos from sites like these.

Im not sure about those communities.
Anyway most people seem to think of deviantart as a site which you can take images from, a sort of a "free hosting site". They should put in mind that works there are copyrighted and should not be used anywhere else without their written permission.

i think there's no way 2 prevent people from stealin' stuff,
since almost the big companie have probs 2 prevent sourcem pix or
whatever stealin'& usin', though i know i can always do better pix'n'stuff the next day

I get a lot of images on Istockphoto.com and I pay for them. I give skins for free, so I am allowed to use their images. And I use my own photos on my work too. I credit them on my website only. I like to keep "secret" where I get some "supplies" to my stuff, because I've been dealing with some copy cats...I mean, people trying to do what I am doing following my steps. Where I go, they go after to get the same material. I am talking about some blogsphere people where I hang on. I mean, I took years to discover a lot of things by myself, reading, searching over the net and recently a lady from my contacts list just copied my html code and started to make templates for others with that. It sucks! And yes, I can't credit every single image I have, because a lot of them I don't remember the owner. In the beggining of my templates production I did not really think about that...happens a lot all over the place and it's nice to give the credit and I will do it if I know the owner. I don't bother with that. To place a link on my work is fine. My graphic collection is from 2000 and just recently I keep in mind copy right stuff.
The Internet is open and when the artist place anything there is a high risk and this artist cannot count only with honest people. So, if is not to share, do not put on the net. A lot of people are not respecful...
I go this way..if there is any image that belongs to you on my work, just tell me and I place a link.

have a program, which insert undeletable code into my pix
thatz how i found those sites through searchengines
