No, I'm not talking about someone stealing the images that you have edited to make your blogskin. What I am talking about here is how the images that you have edited to make your blogskins were probably actually stolen from another site and not properly credited in return.
Popular sites that are often raided, violated, and uncredited include, but are not limited to:
Deviantart: Yes, it is often listed as a resource on many sites, but it is a resource for its resource (brushes, textures, etc), stock images, and downloadables sections. Those are the only areas of deviantart where people can actually use the art that is featured. If you take art from personal artists who submit in photography, photomanipulation, anime, drawing, traditional art, digital art, or any other section, it is considered copyright infringement and it is theft. In other words, you are just as bad, if not worse, than those people who take your layout and do not give you credit.
Except the individuals on deviantart actually put more time into their art that you did on your layout. Oh and it's illegal to take that art. Oh, and you're not even allowed to use it even if you were to give credit. The bottom line is this: if you don't have written permission from the artist, you are not allowed to use it.
gettyimages.com: You're not supposed to use the images at gettyimages.com, because those are actually images that people submit for sale. In other words, it's just like deviantart. All of the vectors on that site where created and submitted by the artists and were meant to be sold. You can't use them if you didn't buy them.
In other words, you're not only stealing the copyrights but you're stealing the artist's profits. Good going.
Brushes: I'm sure that most people don't realize that you actually need to credit brushes, but you do. You need to credit all resources that you use on your layout, because that is part of the agreement when you download the brushes. You using brushes without crediting is like someone using your layout and taking off the credit link.
It's wrong.
Remedies:
1) scanning your own images from magazines.
2) drawing your own images
3) making your own brushes
4) e-mailing the artist and obtaining legitimate permission
5) buying the rights to the images.
6) using legitimately free image services (stockxchange, etc).

(i am here to tell someone with the username niroshan, I DID CREDIT THE PEOPLE WHO I USE THE BRUSHES FROM, so please stop telling me those in my skins' comments? sorry to say that but is kind of irritating)

I use my own images aswell. its much easier when it comes to credits and copyright. AND it feels as if the skin is more "mine" since I have done everything on it.

thanks for this post. I just posted a blog design I made before reading this (and breaking image theft rules). If I hadn't read this, I wouldn't have thought to ask my deviantart sources for permission to use their images. And they were really nice about it.

Yeah people usually think deviantart is a place where you can use those images for free and worse still they never credit the user, they only gave credit to deviantart and deviantart is a place for people to view their art pieces and not use them for their own selfish reasons.
And I realised alot of young teenager have ambitions of becoming a designer because they think it is a easy and they like making layouts. But then they didn't consider the fact that they have to be very talented in the arts because they need to create their own brushes from scratch, capture their own model photographs, draw their own picture, being very skilled in coding and etc.

I see some free images around internet sometimes so I take some and edit them. Didn't know it was actually wrong, really. I'll really credit images to where I got from now. Some times it just slip my mind to were I got the images, and well, I forget the links.
Thanks for setting up this forum post, I really will look into crediting now.

i think it's ok if you have permission from the artist, because that's not stealing, more like borrowing.

It is not an offence to take pictures from other website. Unless you are going to use it to advertise. If people don't want you to take their picture and place it in your own website then what is the point of displaying the picture on the internet. They place it on the internet for everyone to use right? And sometime they credit themselves by linking the pictures. So i don't think you should call it 'image theft'

Yes. The pictures are placed for people to view them. But that doesn't mean we can TAKE them and create our own layout with it. Be it creditting or not, we took their images WITHOUT THEIR WRITTEN PERMISSION. And lady, it's even worse if you don't credit them. Then you'll be just as bad as those who take without creditting. They can sue you for copyright infringement for all they want.

You can get deviantart images, btw, as long as you ask the deviant first. I have a few skins with deviantart images, and the artists gave me permission to use them when I asked.

well, i agree with that. i have this disgusting friend who steals people's display pictures on blogskins.com and use them as her own msn dps. it's sorta irritating/disgusting how she resorts to this kinda stuff just to get more dps. she stole mine, magnette's old one and many more 8|

Ok, I've emailed Gettyimages.com, and this is what they said:
In answer to your queries, we are not able to allow the use of our images on use on blogskins / such sites where the images can be further downloaded; regardless of whether it is a non-profit / for profit site.
This is as per our terms and conditions of our licences, the relevant clause of which I reproduce below:
2.8 Licensee may not make the Licensed Material available in any medium in a manner intended to allow or invite persons to download or extract the Licensed Material.
Do note that unauthorised usages of our images will constitute copyright infringement and is liable for legal action.
10.1 Unauthorized Use. Any use of Licensed Material in a manner not expressly authorized by this Agreement or in breach of a term of this Agreement constitutes copyright infringement, entitling Getty Images to exercise all rights and remedies available to it under copyright laws around the world. Licensee shall be responsible for any damages resulting from any such copyright infringement, including any claims by a third party. In addition and without prejudice to Getty Images' other remedies under this Agreement, Getty Images reserves the right to charge and Licensee agrees to pay a fee equal to up to five (5) times Getty Images' standard license fee for the unauthorized use of the Licensed Material
So, in response to somethingsparkly 's message on top, where it said that a blogskinner wrote in to Gettyimages & that it was fine to take the images for use in blogskins and not commercialism, it is not true.
As you can see from the second part refering to the licensing, legal action is liable to be taken against you.
Now, we're just people blogskinning for the fun of it, &we absolutely do not want to be sued, so I suggest that everybody, please delete your skins with getty images in it.
Also, I guess its high time we actively discourage people from using DeviantArt and Gettyimages 's pictures for their blogskins. Crediting is a must, but respect for other's property is equally important, especially if they specify that the pictures cannot be taken. (:

not all deviantart pictures are barred. you can use DeviantArt STOCK photos &edit them yourself, so long as you read the user's terms &conditions and perhaps get their permission.
if you google STOCK PHOTOS, there are many free photo sites you can use, so google it!

Actually, if you go and chech on the Terms of Service on deviantart.com at http://about.deviantart.com/policy/service/, paragraph 16.
16.Copyright in Your Content
deviantART does not claim ownership rights in Your Content. For the sole purpose of enabling us to make your Content available through the Service, you grant to deviantART a non-exclusive, royalty-free license to reproduce, distribute, re-format, store, prepare derivative works based on, and publicly display and perform Your Content. Please note that when you upload Content, you allow third parties to copy, distribute and display your Content.
I am not sure if this means that you can use the images at DeviantArt.com for free, but I do ask the DeviantArt-ists for their permission before using. I even created an account at deviantart.com for this purpose of being able to seek permission when commenting, just to be on the safe side. Most of them are in fact more than willing if you asked politely.Even if they agree, let them know the URL of the blogskin when its done and leave them credits.

I seldom see people on deviantART asking people to seek for permission should they want to use their work, although that is appropriate. However, if we need a quick answer and want to ask for permission, we might have to wait for a while for an answer. This might bother people, so they simply snap the thing off the Internet.
But honestly, if I find that somebody uses my art and credits me, I would be proud of it. What is troubling is that downloaders tend to remove the credits and claim stuff as their own. The artist might chance upon the blog and track down the blogskinner, thinking that the blogskinner DID NOT credit him. This may create tension. Therefore, I feel that we should ask for permission.
Also, does anybody have extra websites which you can reproduce pictures for free? I have checked out the websites above, but they might not be enough for people who do not have image-editing software.

And then even if you edit a little bit, rightfully it's not entirely yours, unless you've changed more than half of the picture. But you still need to credit the original artist until then. If not, I might as well grab a pic off the page, add in a tiny speck of colour and claim it as mine. Isn't that unfair?

I understand the point you want to make, but somehow, not all of us can really go and draw out something, then scan. As in, we believe what attracts someone to like a blogskin, is the image and layout. If a blogskinner, can't really draw well, or only adopts one style of drawing, maybe his/her skins will not be well accepted or something? I know, um. Crediting is very important

Yup, crediting is really really important.
I've also got a deviantart account just to ask the artists if I can use their stuff.
But seriously, there's a lot of good stock photos out there. I haven't used anything from deviantart in a while, and it doesn't bother me.
And some food for thought: Just getting others' work without changing anything or with the end product looking almost like the original picture, and putting it on some HTML you made... Wouldn't you be prouder of yourself if you worked on it more than that?

so if i were to use any image taken from deviantart(cause i always take it from there), i must ask the deviant for permission? or can i just use it but still credit them. i always credit! I SWEAR!

In answering sweet_surrender's question:
Yes, you need to gain the artist's permission (pm or write them a note/email) before you use their stuff (photographs, photomanip, vector art etc as stated in the first post), unless it's resources like brushes and textures. Because their art is copyrighted, as said in the dA's policy. Crediting without asking is not enough.
As for pictures like artist.. you mean the singers or actors I assume... That has to depend. Their websites might provide freewares or goodies for you to download so I think it's okay to use them.
Actually, there are some other good places you can get images from, for free.

@Jiawen-4ever: By "capturing" if you mean taking pictures, I think that's okay, because the photographs will be taken by you and you will be free to use them. This is unless you're trying to take pictures in places where they specifically say no cameras allowed, of course. ;P
